Agreement
These Terms of Use ("Terms") govern your access to and use of Hikari, a mobile application operated by Quaruty LLC("we," "us," or "our").
By downloading, accessing, or using Hikari, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the app.
Eligibility
You must be at least 13 years old, or the minimum age required by the laws of your jurisdiction, to use Hikari. By using the app, you represent and warrant that you meet these requirements.
The service
Hikari provides daily affirmations, reflection tools, widgets, themes, and related wellness features for personal use.
The app is intended to support mindfulness, motivation, and self-reflection. It is not a substitute for professional medical, psychological, psychiatric, or therapeutic advice.
We may update, modify, suspend, or discontinue features at any time. While we strive to keep Hikari available, we do not guarantee uninterrupted access to the service.
Not medical advice
Hikari is provided for informational and personal wellness purposes only.
The app does not provide medical, mental health, therapeutic, crisis, or professional healthcare services.
If you are experiencing a medical or mental health emergency, contact emergency services or a qualified healthcare professional immediately.
Hikari Plus subscriptions
Certain features of Hikarimay require a paid subscription ("Hikari Plus").
Subscriptions are billed through your Apple ID account and are charged upon confirmation of purchase.
Subscription prices may vary by country or region and are displayed in the App Store before purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You may manage or cancel your subscription through your Apple ID Account Settings.
Any free trial period, if offered, will automatically convert to a paid subscription unless canceled before the trial expires.
Refunds are handled exclusively by Apple in accordance with Apple’s policies. We do not process refunds directly.
Your content and conduct
You retain ownership of any content you create within the app, including journal entries, notes, and other personal content.
You are solely responsible for the content you create, store, or share.
You agree not to:
- Use the app for unlawful purposes
- Attempt to reverse engineer, decompile, or modify the service
- Interfere with the operation or security of the app
- Violate the rights of other users or third parties
- Use the app in violation of applicable laws or regulations
Intellectual property
Hikari, including its software, design, branding, mascot, affirmations library, graphics, and content, is owned by Quaruty LLC or its licensors and is protected by applicable intellectual property laws.
These Terms do not grant you any ownership rights or license to use our trademarks, logos, branding, or other intellectual property except as expressly permitted by law.
Disclaimer of warranties
Hikariis provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
We do not guarantee that the app will be uninterrupted, error-free, secure, or free from harmful components.
Limitation of liability
To the fullest extent permitted by law, Quaruty LLC shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, or business opportunities arising from your use of Hikari.
Our total liability for any claim related to the app shall not exceed the amount paid by you for Hikari Plus during the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.
Termination
You may stop using Hikari at any time by deleting the app.
We reserve the right to suspend or terminate access to the service if you violate these Terms or if required by law.
Privacy
Your use of Hikari is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
Changes to these terms
We may update these Terms from time to time.
Updated versions will be posted on this page with a revised "Last updated" date.
Continued use of the app after changes become effective constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Wyoming.
Entire agreement
These Terms constitute the entire agreement between you and Quaruty LLC regarding your use of Hikari and supersede all prior agreements relating to the service.
Apple Standard EULA
Hikariuses Apple's Standard Licensed Application End User License Agreement (EULA).
In the event of any conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall apply where required by law.
